2. USERS:

Access and/or use of this portal attributes to the person who does so the condition of USER, accepting by said person, from said access and/or use, the General Conditions of Use reflected here. The aforementioned Conditions will apply regardless of the General Contract Conditions that may be mandatory.

3. USE OF THE PORTAL:

www.discoverybuilding.es provides access to a multitude of information or data (hereinafter, “the contents”) on the Internet belonging to Colonial or third parties. The USER assumes responsibility for the use of the portal.

The USER undertakes to make appropriate use of the content and services (such as discussion forums, communication channels) that Colonial offers through its portal and, by way of example but not limited to, not to use them for (i) engage in activities that are illicit, illegal or contrary to good faith and public order; (ii) disseminate content or propaganda of a racist, xenophobic, illegal pornographic nature, in support of terrorism or in violation of human rights; (iii) cause damage to the physical and logical systems of Colonial, its suppliers or third parties, introduce or spread computer viruses or any other physical or logical systems that may cause the aforementioned damage; (iv) attempt to access and, where appropriate, use the email accounts of other users and modify or manipulate their messages.

4. INTELLECTUAL AND INDUSTRIAL PROPERTY:

All content on the Colonial website, including, but not limited to, texts, documents, photographs, drawings, images, icons, graphic representations, audiovisual or sound content, as well as its graphic design and source code, trademarks, trade names or other distinctive signs, are the exclusive property of Colonial or third parties and are protected by Industrial and Intellectual Property Laws, unless otherwise specified.

In accordance with the above, the user must respect all intellectual and industrial property rights on the Colonial website that are owned by Colonial or third parties, and any form of exploitation, reproduction, distribution, modification, public communication, transfer or transformation or any other form of dissemination of the information or elements contained on the Colonial website mentioned in this section, using any medium or means, not expressly and previously authorized by their respective owners, is expressly prohibited. The content of this website may be viewed, printed, copied and stored on your computer’s hard drive or any other physical medium provided that it is solely and exclusively for your personal and private use without any commercial purpose.

The infringement of any of the aforementioned rights may constitute a violation of these conditions, of the Industrial and Intellectual Property laws, as well as a crime punishable in accordance with articles 270 and following of the Criminal Code.

5. EXCLUSION OF WARRANTIES AND LIABILITY:

Colonial does not guarantee continued access, nor the correct viewing, downloading or usefulness of the elements and information contained on the Colonial website, which may be impeded, hindered or interrupted by factors or circumstances beyond its control.

Colonial is not responsible for the information and other content integrated into third-party spaces or web pages accessible from the Colonial portal through links, hyperlinks or links to www.discoverybuilding.es, nor for the information and content of any third-party website that is presented under the appearance or distinctive signs of Colonial.

Colonial assumes no responsibility for any content accessed through the Colonial website but provided by third parties or entities, and in particular for any damages of any kind that may arise from:

(i) absence or deficiencies in the information provided to users or in its truthfulness, accuracy and sufficiency;

(iii) failure to comply with the obligations incumbent on information society service providers;

(iv) infringement of consumer and user rights;

(v) infringement of intellectual and industrial property rights; carrying out acts of unfair competition or illegal advertising;

(vi) infringement of the right to data protection; of professional secrecy and of the rights to honour, personal and family privacy and the image of persons; and

(vii) in general the non-compliance with any laws, customs or codes of conduct that may apply.

Colonial assumes no responsibility for any damages, losses, claims or expenses arising from:

(i) interferences, interruptions, failures, omissions, telephone breakdowns, delays, blockages or disconnections in the operation of the electronic system, caused by deficiencies, overloads and errors in the telecommunications lines and networks, or by any other cause beyond the control of Colonial;

(ii) illegitimate interference through the use of malicious programs of any kind and through any means of communication, such as computer viruses or any other;

(iii) improper or inappropriate use of the Colonial website;

(iv) security or navigation errors caused by a malfunction of the browser or by the use of non-updated versions of the browser.

In any case, the USER of the Colonial portal will be responsible for damages of any kind that Colonial may suffer as a result of the USER’s failure to comply with the obligations to which he is subject by this Legal Notice, or by the specific conditions that apply to him.

6. SECURITY POLICY:

The creation of links to the Colonial website from third-party websites is prohibited without the express written authorization of Colonial.

Access to the portal does not imply any obligation on the part of Colonial to control the absence of viruses or any other harmful computer element. In any case, it is the USER’s responsibility to have the appropriate tools available for the detection and disinfection of harmful computer programs.

Colonial is not responsible for any damage to the computer equipment of users or third parties during the provision of the portal service.

7. MODIFICATIONS:

Colonial reserves the right to make any changes it deems appropriate to its portal without prior notice, and may change, delete or add content and services provided through the portal, as well as the way in which they are presented or located on the portal.

8. RIGHT OF EXCLUSION:

Colonial reserves the right to restrict access to the portal and/or the services offered without prior notice, at its own request or that of a third party, to those users who fail to comply with these General Conditions of Use, as well as any subsequent modifications.

9. GENERALITIES:

Colonial will pursue non-compliance with these conditions, as well as any improper use of its portal, by exercising all civil and criminal actions that may be applicable by law.

10. MODIFICATION OF THESE CONDITIONS AND DURATION:

Colonial may modify the conditions set forth herein at any time, and these will be duly published as they appear here. The validity of the aforementioned conditions will depend on their exposure and will be valid until they are modified by other duly published conditions.

11. APPLICABLE LEGISLATION AND JURISDICTION:

For the resolution of any conflict arising from access to the website, the USER and Colonial expressly agree to submit to current Spanish regulations and the courts of the city of Barcelona, waiving any general or special jurisdiction that may apply to them.
